Orders – Stahly Quality Foods Ltd. take no responsibility for an order until that order is received in writing and may choose not to accept an order for any reason.

Complaints – We will endeavour to respond to all complaints within five working days and aim to resolve all complaints within one calendar month.  We will keep customers informed throughout the complaints procedure.

Guarantee of Quality – Stahly Quality Foods Ltd. guarantees that all of our products are of the highest quality and meet current EU legislation standards.  Every effort is made to ensure that all products arrive in perfect condition.  However, in the unlikely event of any product not being delivered within 14 working days from the date of despatch, the Purchaser should advise Stahly Quality Foods Ltd. and a full refund will be made.  If any products arrive damaged the Purchaser should advise Stahly Quality Foods Ltd. within 7 working days of receipt of the order.  Depending on our customers preference, we will arrange for the damaged product to be uplifted and returned to us and a replacement product sent or a refund made for the value of the goods on return to us.  We will not refund for perishable items within an order which is not delivered in time as a result of an incorrect address being given by the Purchaser.

Delivery – Delivery of the goods shall be made to the customers address specified on the order and the customer must make all arrangements necessary to take delivery of the goods from the carrier.  Risk in the goods will be passed to the customer upon delivery or, where the customer fails to take delivery, at the time when delivery was attempted. Stahly Quality Foods will not pay the cost of a re-delivery.

Customs Regulations – Subject to customers receiving clearance with international customs, we will send our tinned haggis to non EU countries.  Stahly Quality Foods Ltd. will not be responsible for orders that are held by Customs and will not offer a refund for any delay in the delivery of an order.  The legal responsibility for all orders sent to non EU destinations will be that of the person placing and paying for the order.  Stahly Quality Foods Ltd. will, in no way, be liable for any legal claim or customs actions that are raised as a result of any order that is made for delivery outside of the European Union.

Stahly Quality Foods regret that for reasons mainly connected with import restrictions, there are limitations on sending haggis to certain countries.

Regulations and restrictions are continually changing and, therefore, the following list is neither exhaustive nor conclusive and should be used as a guide only.  If there are any doubts, you should always check with your local customs office for clarity.  As per our terms and conditions, all customs clearance is the ultimate responsibility of the customer and Stahly Quality Foods will not be held responsible for delivery failure.

Payment – We accept all major credit cards and debit cards and use a secure payment system via RMS and PayPal.

Title of Goods – All products remain the property of Stahly Quality Foods Ltd. until  paid for in full.

VAT and Local Tax – These are the responsibility of the Purchaser or the recipient in the county of destination.

Force Majeure – Stahly Quality Foods Ltd. will make every reasonable effort to meet despatch dates.  However, we will not be liable for any loss, damage or delay resulting from circumstances outside our control, including but not limited to acts of God, strikes, acts or omissions of the Purchaser, accidents, war, fire, acts of civil or military authority judicial action, defaults of sub-contractors or suppliers, failure of communications, telecommunications or computer systems, breakdown of plant or machinery, shortage or unavailability of raw materials from a natural source of supply, failure or delay in transportation, embargoes, labour disputes, or riots.

Insurance – Liability insurance is included

Local Taxes – Any local taxation or duty payable on the goods will be the responsibility of the purchaser and must be paid on receipt of the goods.

Law – These terms and conditions shall be governed by and construed in accordance with the law of Scotland and you hereby submit to the exclusive jurisdiction of the Scottish courts.

Perishable Foods – Our products are all despatched in perfect condition and we will not be held responsible for any deterioration in the quality of perishable goods which have not been delivered in time.  Receipt of your order is deemed to be your acceptance of this condition.

Cancellation and Returns – Customers have the right to cancel their order up to the point of despatch and any payment made will be refunded within 28 days.  Customers have the right to cancel the order within seven working days of receipt of the goods.  A full refund will be made for the goods once returned.  The returned goods must be in their original packaging and adequately insured for the return journey.  The cost of returning the goods will be the responsibility of the customer.  Perishable goods are not returnable and payments for perishable goods will not be refunded.  If the customer fails to return the goods following cancellation, Stahly Quality Foods Ltd. will be entitled to deduct the cost of recovering the goods from the customer.  Where returned goods are found to be damaged due to the customers fault, the customer will be liable for the cost of remedying such damage.

Faulty Goods – Damages and discrepancies to orders must be reported to Stahly Quality Foods Ltd. by telephone or e-mail within 7 working days.  Failure to do so, will be deemed as the customers acceptance of the goods.  A full refund for the goods and return carriage costs will be made for faulty goods.  Alternatively, replacements may be sent.

Stock – We reserve the right to substitute any product with another product of equal or greater value and quality.  All products are subject to availability.

Rights of Supplier – Stahly Quality Foods Ltd. reserve the right to up-date prices on www.thehaggis.com at any time.  We will make every effort to ensure that prices are correct at the point at which the customer places an order.  Stahly Quality Foods Ltd. reserve the right to withdraw products from sale at any time.

Changes to Terms and Conditions – Stahly Quality Foods shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

Acceptance of Terms – Access to and use of www.thehaggis.com constitutes your full acceptance of the terms and conditions of this website.
